Terms of Service
Last updated: [OWNER: effective date]
These Terms of Service (“Terms”) govern access to and use of Outbid at playoutbid.com (the “Service”), operated by [OWNER: legal business name] (“we”, “us”).
1. What Outbid is
Outbid is a public permanent-bid leaderboard. Users may pay one-time amounts to permanently increase a product’s accumulated bid. Higher accumulated bids generally rank higher. This is not an auction with a closing time, and payments are not subscriptions.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and provide accurate account information. You are responsible for activity under your account.
3. Products and moderation
Submitted products are subject to moderation. We may approve, reject, hide, or remove products that violate these Terms, applicable law, or our rules—including prohibited, fraudulent, misleading, or abusive content—without guaranteeing review timelines.
4. Payments and bids
- Payments purchase a permanent increase to a product’s accumulated bid.
- Payments do not guarantee traffic, users, revenue, business success, or uninterrupted ranking.
- Positions can change when others bid higher.
- Successful payments are applied only after payment-provider verification (webhook). Success-page redirects alone do not award bids.
- Currency, minimums, and maximums are set by the Service and shown at checkout.
5. Prohibited conduct
You may not engage in fraud, payment abuse, chargeback misuse, manipulation of rankings or metrics, unauthorized access, scraping that harms the Service, or submission of illegal or infringing content.
6. Intellectual property
You retain rights to content you submit, and grant us a license to host and display it as needed to operate the Service. Outbid branding and software remain ours or our licensors’.
7. Disclaimers
The Service is provided “as is” without warranties of uninterrupted or error-free operation. Ranking and visibility are not promises of commercial results.
8. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising from the Service is limited to the amounts you paid to us for the specific transaction giving rise to the claim in the twelve months before the claim. [OWNER: confirm jurisdiction-specific liability language.]
9. Changes
We may update these Terms. Continued use after changes become effective constitutes acceptance of the updated Terms.
